upgrade to 4 via 1password application 3.8.22
I have one machine running 10.8.5, the rest are 10.6 critters. Not terribly impressed with osx 10.x, but would like to upgrade my 10.8 to 4 (I understand 5 is for 10 and up). Can I do this from my 1password application? (yes I am a bit lazy) and how much (the app wanted me to upgrade to 5 at 24.99) thanks

The license for version 4 is the same as the one for version 5, since the upgrade to version 5 is free to registered version 4 users. What you are seeing is the upgrade price from 1Password 3 for either. You will get a version 5 license from the AgileBits web store, apply it to the version 4 installation you want. And, when you get ready to upgrade your OS X to Yosemite or later, you'll be all set for version 5 without paying again.
I don't know if you can make your buy from inside the 1Password 3 application. I think that ability came during the updates to version 5, but I could be wrong. But you seem to be saying that you have checked the upgrade price from within 1Password.
