why was i charged for a 'free' upgrade?
Agilebits has been pushing a free upgrade to 1password 5 for 1password 4 users. Yet when i followed the instructions to download version 5 from itunes, i was charged $52.99. When I wrote to iTunes, they said they are just the intermediary, and the responsibility is AgileBit's. how do i get a refund?

AgileBits does set the price on the Mac App Store, but they don't handle checking whether your last purchase was made from Apple. In fact, Apple provides them with no information at all about who bought a license from Apple. It would be tied to your Apple ID, and if you bought version 4 there, you would not have been charged to download version 5.
What I suspect may have happened to you is that you purchased your license to version 4 from the AgileBits web site, not from the Mac App Store. If that is the case, your upgrade to version 5 would have needed also to be downloaded from AgileBits, not Apple. And there would be no charge for the upgrade from version 4 to version 5. You would simply have applied the license file you have for version 4 to version 5.
If that describes your situation (and if it doesn't, please post back), you'll want to ask Apple for a refund for your mistaken purchase from the Mac App Store. They will be the only ones who would be able to help you on that count.

A couple of things here,
It likely or possible you purchased 1Password under a different ID than was used to purchase it originally. This is often the case and happens all the time when folks change Apple ID's.
Or maybe you purchased from the Mac App Store when you had an earlier purchase from the website version. The stores are not interchangeable and version can not be swapped for one another.
The upgrade was only for people whom previously held a license to 1Password 4, not 1Password 3 for example. Just as you indicate above, but posted here in case someone else finds this thread.
As to a refund, the Mac App Store is the entity doing the selling, its their store. They manage and process all transactions. They are the ones to do the refunding. They do not share details of purchases with AgileBits, so there is no way for AgileBits to know you indeed purchased it and are thereby qualified for a refund.
To get that refund you would need to specifically ask the Mac App Store for that refund.
If you can provide more details maybe the staff can help you try to figure it out. However that help is very limited by the fact that the Mac App Store does not share those purchase details.
I think all they could do is look for a purchase history for the website version of 1Password 4 from you.

i have had 1password since 2009 (key XXXXX.) In November 2013, i purchased a family license (key XXXXX.) I have two email addresses, XXXXX, and XXXXX. Thank you.

I removed the email addresses and license codes you posted, as this forum is searchable by Google so it's not a good thing to post that information publicly (for example, your email addresses could get harvested by spambots).
Before removing that info, I was able to use it to find your purchases in our system, so I can confirm that you bought the upgrade for 1Password 4 for Mac from our own web store. The Mac App Store version of 1Password is a completely separate purchase, as Apple has no way of knowing that you already bought it from us. That's why you were charged separately when you bought it from the Mac App Store.
Apple maintains all control over transactions made on the Mac App Store. To get a refund for that purchase, you'll need to click the Report a Problem link on the receipt they sent you, and request the refund from them.
You can download the web store version of 1Password 5 for Mac from our download site. You may need to add your license file to activate it. If you don't have a copy of that license file, you can download a new copy. I can resend your license info to your email, but it looks like your licenses are listed under 3 different email addresses in our system, so I'll send you a private message about that.
